Charles A. Hummer v. Adams Homes of Northwest Florida, Inc. & Nu Way Drywall, LLC

Hummer purchased a home in 2007 built by Adams Homes. He later filed a suit (in 2014) alleging defective drywall as part of the construction defects.
 

  • The Second District Court of Appeal affirmed dismissal of the property damage claims as time-barred (statute of limitations), but reversed the dismissal of claims for personal injuries, remanding that part for further proceedings.
     
  • This case is useful as it involves Adams, latent defects (drywall), and the legal debate over accrual and tolling of limitations in construction defect contexts.

This is a case focused on the insurer’s duty to defend/indemnify Adams Homes in a state court suit brought by homeowners.
 

  • The underlying homeowners’ lawsuit involved allegations of drainage/flooding issues in a development known as Driftwood Estates. Adams was alleged to have built homes in areas of shifting water flow, used impeding fill material, and otherwise compromised natural drainage, resulting in flooding and property damage.
     
  • Although this is not a classic window/door leak case, it is relevant for showing how developers can be held liable for systemic design and construction defects in subdivisions (especially when the defects are community‐scale, e.g. affecting multiple homes).
